Terms of Use

These Terms of Use ("Terms") govern your access to and use of plamanndigital.com and its related pages, forms, and content (the "Site"). The Site is operated by Plamann Digital ("Plamann Digital," "we," "us," or "our").

By using the Site, you agree to these Terms. If you do not agree, do not use the Site. You must be at least 18 years old or have legal authority to act for the business you represent.

The Site provides general information about Plamann Digital and our website, hosting, maintenance, and related digital services. Site content is provided for general informational purposes and is not legal, tax, accounting, or other professional advice.

We work to keep information accurate and current, but we do not promise that every statement, price, example, timeline, or feature on the Site will always be complete or available.

Using the Site, submitting a form, or discussing a project does not create a client relationship or require either party to move forward. Any paid work will be governed by a separate proposal, service agreement, statement of work, invoice terms, or other written agreement accepted by Plamann Digital and the client.

If a separate written agreement conflicts with these Terms about paid services, that agreement controls for those services. Quotes, timelines, and availability may change until both parties accept the applicable written agreement.

You agree not to use the Site to:

• Break any law or violate another person's rights.
• Submit false, misleading, fraudulent, harmful, or unlawful material.
• Probe, scan, disrupt, overload, or attempt to bypass the Site's security or operation.
• Introduce malware, automated spam, scraping tools, or other harmful code or traffic.
• Copy, reverse engineer, or exploit the Site except as applicable law expressly permits.
• Impersonate another person or misrepresent your authority to act for a business.

We may restrict access to protect the Site, our business, or others.

The Site, including its design, text, graphics, branding, layout, code, and original content, is owned by Plamann Digital or used with permission and is protected by intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for lawful personal or internal business purposes. No other rights are granted. Plamann Digital's name, logo, and branding may not be used without prior written permission.

You retain ownership of information and materials you submit. You give us permission to use them as reasonably necessary to respond to your request, evaluate a project, provide agreed services, operate our business, and comply with law.

You represent that you have the right to submit those materials and that our permitted use will not violate another person's rights. If you voluntarily send general suggestions or feedback, we may use them without restriction or compensation, provided we do not publicly identify you without permission.

The Site may contain links to or rely on third-party websites, platforms, or services. We do not control third parties and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by that provider's terms and policies.

To the maximum extent permitted by law, the Site is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that using the Site will produce a particular business, marketing, search-ranking, or revenue result. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

To the maximum extent permitted by law, Plamann Digital and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the Site.

To the maximum extent permitted by law, our total liability arising from or related to the Site will not exceed one hundred U.S. dollars ($100). These limits do not apply where liability cannot lawfully be excluded or limited. Liability relating to paid services is governed by the applicable written client agreement.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Plamann Digital and its owners, personnel, and contractors from third-party claims, damages, losses, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms, or materials you submit without the necessary rights.

Our collection and use of personal information is described in our Privacy Policy. By submitting information through the Site, you acknowledge that policy.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute relating to the Site or these Terms must be brought in a state or federal court located in Wisconsin, unless applicable law requires otherwise. You and Plamann Digital consent to the jurisdiction of those courts.

We may update these Terms by posting a revised version on the Site and changing the effective date. Your continued use of the Site after an update means you accept the revised Terms.

If a provision of these Terms is found unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of that provision.
